Terms & Conditions

By using the iMediaTours.com website and the services, you accept and agree to be bound by the following terms and conditions.

The following events will result in a $25.00 cancellation fee:

1-Any virtual tour order cancellation made after 5:00pm, one business day in advance of the scheduled shoot will incur a fee. Any virtual tour order cancellation must be made by contacting Interior Media at 951-672-3361 between 8:30 a.m. and 5:00 p.m. PST, Monday through Friday.
2-*Either the agent, an authorized representative appointed by the agent, or the homeowner must attend the shoot. If the photographer arrives at the property and the designated person is not in attendance by the appointed time, a cancellation fee may be charged. The appointment may be rescheduled for a later date.
3-The home must be clean and presentable at the scheduled time of the tour.
4-The agent must provide the valid address of the home at tour purchase.
5-An agent may substitute one home for another home in the same area, but must do so more than four business hours prior to the originally scheduled time or they will be assessed a cancellation fee.

*At agent or homeowners request, photographer may complete shoot without agent or homeowner presence. Agent or homeowner will need to make arrangements for entry with photographer prior to appointment time. This will be at photographers sole discretion and with the understanding that:
1-Neither photographer, nor Interior Media, will be held liable for any damages that may occur.
2- If at agents request, agent is assuming the responsibility of informing homeowner of Interior Media's terms and conditions and upon acceptance of these terms and conditions requesting permission from homeowner to allow photographer unsupervised entry. By granting photographer access, agent is stating that this requirement has been met and assumes all responsibility for any consequences.

Because of safety and liability issues, scheduled shoots may be delayed or rescheduled due to inclement weather at the photographer’s sole discretion. If the shoot is unable to be rescheduled, there will be no charge for the cancellation. Once the photographer has photographed a home, the tour may not be cancelled. The agent will be charged the full price of the tour. The Interior Media photographer will shoot the home as-is. That is, (s)he will not move objects, straighten or dust objects, etc. The photographer will, however, turn lighting on or off and open or shut blinds if it results in better images. If the appearance of any photograph is unsatisfactory, Interior Media will review it to determine whether a retake is necessary and who will incur the expense of the retake. Interior Media reserves the right to have the final decision on such retake requests. Retakes necessary due to quality issues clearly resulting from incorrect camera settings will be retaken at no additional cost.

If neither agent nor homeowner is present at the time the tour is photographed, and the agent has made no prior requests regarding shot selection, the shots taken will be at the discretion of the photographer. Interior Media claims no responsibility for the photographer’s selection of shots except in cases of extreme negligence. Interior Media will process each virtual tour image unless Interior Media deems it to the agent’s or homeowner’s best interest to not exhibit a particular image. This may be the result of poor lighting, bad weather, decrepit or unclean room or scene, etc. All images and media furnished by Interior Media are the sole property of Interior Media. Interior Media reserves all rights to these images, media and content. All images, photographs and media are made available to client until the property is sold or the listing is cancelled/expired. (Unless otherwise specified in writing)

A virtual tour will be posted to the Interior Media website(s) only upon receiving required information as specified at time of scheduling. This information includes but is not limited to: MLS number, asking price, address, square footage, the number of bedrooms and bathrooms. Interior Media is not responsible for any delays that are the result of missing or incorrect information. The virtual tour will become inactive after one year from date of posting. The tour can be reactivated at any time. Interior Media reserves the right to charge an annual fee (upon agent notification) for any tour that is hosted by Interior Media for over a year.

This Service is provided "AS IS" and "AS AVAILABLE" with any representation or warranty of any kind, expressed or implied, as to this site and its operation. Interior Media makes no warranty that the site will be uninterrupted, timely, secure, or error free.

Interior Media is not responsible for posting tours to websites. It is the agent’s responsibility to post the tour on the agent’s MLS. This is usually a simple process. We strive to provide detailed instructions for linking tours to MLS's during the tour order process. If you need help linking your tour, please contact your MLS tech support. Interior Media cannot assume responsibility for problems arising with the MLS.

"Photograph(s)" means all photographic material furnished by Interior Media hereunder, whether transparencies, negatives, prints, digital media or otherwise. Except as otherwise specifically provided herein, all photographs and rights therein, including copyright, remain the sole and exclusive property of Interior Media.
Agent will not prevent Interior Media from making or permitting any alterations, additions, or subtractions in respect of the photographs, including without limitation any digitalization or synthesizing of the photographs, alone or with any other material, by use of computer or other electronic means or any other method or means now or hereafter known. Agent will indemnify and defend Interior Media against all claims, liability, damages, costs, and expenses, including reasonable legal fees and expenses, arising out of any use of any photographs for which no release was furnished by Interior Media, or any photographs which are altered by Agent. Unless so furnished, no release exists. Interior Media's liability for all claims shall not exceed in any event the total amount paid under the related invoice. Agent shall indemnify Interior Media against all claims, liability, damages and expenses incurred by Interior Media in connection with any third party claim arising out of use of said material hereunder. Time is of the essence for receipt of payment and return of media. No rights are granted until timely payment is made. Client may not assign or transfer this agreement or any rights granted hereunder. This agreement binds and inures to the benefit of Interior Media, Agent, Agent's principals, employees, and affiliates, and their respective heirs, legal representatives, successors and assigns. Agent and its principals, employees, and affiliates are jointly and severally liable for the performance of all payments and other obligations hereunder. No amendment or waiver of any terms is binding unless set forth in writing and signed by the parties. However, the invoice may reflect, and Client is bound by, oral authorizations for fees or expenses which could not be confirmed in writing because of immediate proximity of shooting. This agreement incorporates by reference Article 2 of the Uniform Commercial Code, and the Copyright Act of 1976, as amended. Any dispute regarding this agreement shall be arbitrated in the State of California under rules of the American Arbitration Association and the laws of State of California. Judgment on the arbitration award may be entered in any court having jurisdiction. Agent hereby expressly consents to the jurisdiction of the Federal courts with respect to claims by Interior Media under the Copyright Act of 1976, as amended.

Debtor agrees to be responsible for payment of any debt to creditor OR ITS ASSIGNS.

Interior Media reserves all rights to update these Terms and Conditions at any time.
